Prohibited Items Policy

1.1. This Prohibited and Restricted Items Policy (the "Policy") details items that are prohibited (cannot be listed or sold under any circumstances) or restricted (may be sold only under specific conditions or require explicit pre-approval) on the Cookiee Platform ("Platform"), operated by Cashless Technologies India Private Limited ("Company", "We", "Us", "Our").

1.2. The purpose of this Policy is to ensure absolute compliance with all applicable Indian laws and regulations, protect the safety and financial well-being of Buyers and Sellers, maintain the operational integrity of the Platform, and adhere to ethical commerce standards. It fulfills Cookiee's continuous due diligence obligations as an "Intermediary" under Section 79 of the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules"). Further, compliance with obligation under Consumer Protection (E-Commerce) Rules, 2020, including obligations relating to marketplace due diligence, grievance handling, seller KYC, product authenticity controls, and unfair trade practice prevention.

1.3. All Sellers ("You", "Your") must strictly comply with this Policy at all times. Listing prohibited or restricted items in violation of this Policy is a serious offense and constitutes a material breach of the Cookiee Seller Agreement. It is the Seller's sole responsibility to ensure their listings comply with this Policy and all applicable laws. The Seller assumes full criminal and civil liability and shall entirely indemnify and hold Us harmless for any non-compliant listings.

1.4. Violations of this Policy will result in immediate enforcement actions, including but not limited to listing removal, the withholding of ledger payouts, the enforcement of rolling risk reserves, and the permanent suspension or termination of Your Seller Account.

1.5. This list is non-exhaustive, and the Company reserves the absolute and unilateral right to determine, in its sole discretion, whether an electronic item or listing is prohibited or harmful to the brand equity of Cookiee, and to remove any such listing without prior notice. Further, Cookiee reserves the right to proactively delist listings based on fraud-risk signals, excessive return patterns, IMEI mismatch reports, law-enforcement notices, consumer complaints, or logistics partner alerts.

Sellers are strictly prohibited from listing or selling any hardware asset, item, or software tool that is illegal in India, facilitates illegal activity, or is restricted by Cookiee as outlined below. Sellers are solely responsible for ensuring any item they list complies with these rules and all prevailing statutes.

2.1.1. Narcotics, illegal drugs, controlled substances (as defined by the Narcotic Drugs and Psychotropic Substances Act, 1985), steroids, and related packaging paraphernalia.

2.1.2. Counterfeit currency, coins, stamps, or forged government documents.

2.1.3. Stolen property, black-market cargo, or electronic items obtained through illegal or unauthorized means.

2.1.4. Content or listings that violate Rule 3(1)(b) of the IT Rules, 2021, including information that is blatantly false and untrue, defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, insulting or harassing on the basis of gender, libelous, or relating to or encouraging money laundering or gambling.

2.1.5. Human organs, remains, or any products derived from the human body.

2.1.6. Sellers must ensure IMEI/serial numbers uploaded on the platform match packaging, invoice records, OEM records, and shipment metadata. Devices with altered, cloned, wiped, spoofed, or unreadable International Mobile Equipment Identity (IMEI) strings or manufacturer Serial Numbers.

2.1.7. Hardware, software, mod chips, or digital utilities primarily designed to jailbreak, root, unlock network carriers illegally, or bypass remote mobile device management (MDM) systems.

2.1.8. Software programs, tools, or crack files intended to circumvent, strip, or exploit hardware activation locks (including, without limitation, iCloud Locks, Google Factory Reset Protection, or Knox Security blocks). Any listing of devices with bypassed activation locks, rooted operating systems, beta firmware, or unauthorized enterprise profiles shall be presumed fraudulent unless validated by OEM authorization

2.2.1. Counterfeit merchandise: Items bearing a trademark or logo identical to, or substantially indistinguishable from, a registered brand trademark without explicit commercial authorization.

2.2.2. Cloned electronic items or replica hardware units designed to visually mimic branded smartphones, tablets, laptops, or wearables (including "AAA Clones" or functional dummy units).

2.2.3. Counterfeit internal components or parts harvested from unauthorized device teardowns (including counterfeit or unvetted lithium-ion replacement batteries, third-party logic board chips, or copycat camera modules).

2.2.4. Uncertified third-party charging bricks, power adapters, or electronic accessories failing to possess valid Bureau of Indian Standards (BIS) electronic safety compliance markings.

2.2.5. Replicas, pirate copies, or unauthorized dumps of software, operating systems, mobile applications, or game console keys.

2.3.1. Explosives, fireworks, pyrotechnic devices, blasting caps.

2.3.2. Flammable gases, compressed aerosols, or volatile chemical liquids.

2.3.3. Damaged, swollen, defective, or recalled standalone lithium-ion batteries.

2.3.4. Electronic cigarettes (e-cigarettes), vapes, Electronic Nicotine Delivery Systems (ENDS), and any replacement parts or heating coils thereof, in strict accordance with the Prohibition of Electronic Cigarettes Act, 2019.

Sellers must also comply with applicable DGCA, IATA, courier, and battery transportation rules for shipping lithium-ion devices and accessories

2.4.1. Firearms of any type (including handguns, rifles, air guns, and component parts), ammunition, live or blank cartridges, and gunpowder.

2.4.2. Stun guns, tasers, pepper spray, mace, or electroshock devices.

2.4.3. Tactical knives primarily designed as weapons, switchblades, butterfly knives, push daggers, disguised knives, or concealed blades.

2.5. Regulated Medical Devices: Regulated medical equipment that requires a specialized clinical prescription, a specific state license to sell, or administration by a qualified healthcare professional under the Medical Devices Rules, 2017, is strictly prohibited unless the seller possesses and can demonstrate explicit pre-approval from the Cookiee legal team.

2.6. Adult Content and Obscene Materials: Items containing pornography, illegal obscenity, or content deemed inappropriately sexually suggestive or exploitative are strictly prohibited, in compliance with the POCSO Act, Section 196 of the Bharatiya Nyaya Sanhita, 2023, and Sections 67/67A of the Information Technology Act, 2000.

2.7. Offensive and Controversial Materials: Items, listings, or metadata that promote, incite, or glorify hatred, violence, caste discrimination, communal intolerance, or religious desecration under Indian law or reasonable community standards are strictly prohibited.

2.8.1. Real or counterfeit government IDs (Passports, [Aadhaar Redacted], PAN cards, Voter IDs, Driver's Licenses), visas, or official badges.

2.8.2. Circulating paper currency, coins, or stamps sold for monetary face value or exchange.

2.8.3. Stocks, bonds, securities, debentures, Virtual Digital Assets (VDA), including cryptocurrencies, or other regulated financial tokens.

2.8.4. Active credit cards, debit cards, or stored-value cards possessing redeemable monetary balances.

2.9. Recalled Products: Electronic products subject to a voluntary or mandatory recall by the original manufacturer, brand holder, or any domestic or international regulatory authority due to safety concerns, battery combustion threats, or non-compliance are strictly prohibited. Sellers must continuously monitor recalls for their catalog items and remove affected listings immediately.

2.10. Gambling and Lottery Items: Items associated with gambling, lotteries, raffles, or games of chance are strictly prohibited. This includes lottery tickets, raffle entries, functional slot machines, digital betting utilities, or hardware devices designed to facilitate unauthorized gambling. Cookiee reserves the right to suspend seller catalog visibility pending investigation of recall notices or safety incidents

2.11. Services: The Cookiee platform is strictly intended for the retail sale of authorized, factory-sealed physical electronic goods. The listing, advertising, or offering of commercial technical services—including hardware repair, screen replacements, component micro-soldering, operating system flashing, or activation unlocking—is completely prohibited. Installation support, warranty activation support, and OEM-authorized after-sales support may be allowed only if separately approved by Cookiee

2.12. Chance-Based Items / Mystery Boxes: Listings offering items where the specific contents, specifications, or conditions are unknown to the Buyer prior to purchase are strictly prohibited. This includes mystery boxes, grab bags, surprise boxes, or tech loot boxes.

2.13. Duty to Disclose Recalls: The Seller shall formally notify the Company via the merchant dashboard within twenty-four (24) hours if any product listed on the Platform becomes the subject of an active voluntary or mandatory safety recall by any regulatory authority or manufacturer.

3.1. Violation of this Prohibited and Restricted Items Policy is considered a serious offence and a material breach of the Seller Agreement.

3.2. Any such violation may result, at the Company's sole discretion, in one or more of the following administrative and legal enforcement actions:

3.2.1. Immediate removal or modification of the non-compliant listing(s) without prior notice or refund of platform credits.

3.2.2. Immediate temporary or permanent suspension of the Seller's dashboard listing privileges or entire Account.

3.2.3 Freezing and withholding of pending ledger payouts associated with transactions involving prohibited items.

3.2.4. Implementation of rolling financial risk reserves or the extraction of liquidated damages from the merchant's escrow balances.

3.2.5. share details of illegal items, transaction logs, hardware logs, device identifiers, merchant’s KYC details, shipment records, and payment trail information with regulators, payment aggregators, OEMs, or law-enforcement

3.3 Cookiee may share transaction logs, device identifiers, KYC details, shipment records, and payment trail information with regulators, payment aggregators, OEMs, or law-enforcement agencies for fraud prevention and statutory compliance.

4.1. Sellers shall maintain verifiable procurement documentation, GST invoices, serial number mapping, and OEM traceability records for a minimum period of eight (8) years.

4.2. Cookiee may conduct periodic audits, mystery shopping exercises, serial number verification, and compliance reviews to detect counterfeit, stolen, refurbished-as-new, or unauthorized inventory.

4.3. Cookiee may suspend listings or seller accounts where unusually high return rates, fake-delivery complaints, chargebacks, refund abuse, or activation-lock complaints are observed.

4.4. Sellers must cooperate with customer grievance investigations, OEM verification requests, and law-enforcement inquiries within timelines prescribed by Cookiee.

5.1. This Prohibited and Restricted Items Policy may be updated or modified immediately by the Company from time to time, particularly to adapt to emerging fraud loops cybercrime patterns, OEM abuse report, sanctions advisory, regulatory directions, hardware security risks, or statutory adjustments.

5.2. Material changes will be communicated via the merchant dashboard control center or transmitted via email notice seven (7) days prior to taking effect, except for changes required immediately by sovereign executive Law.

5.3. Continued use of the Platform or the maintaining of live listings after changes to the Policy become effective will constitute explicit, unconditional, and legally binding acceptance of the revised Policy framework.
